Terms of Use

1. License

The mobile applications are licensed, not sold. The Developer grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license to use one copy of each application for your personal non-commercial use on a single device. The rights granted herein are subject to your compliance with these Terms. The applications are being licensed to you and you hereby acknowledge that no title or ownership in the applications is being transferred or assigned and these Terms are not to be construed as a sale of any rights in the applications.

2. Restrictions of Use

Unless the Developer has authorized you to distribute the Services, you shall not make or distribute copies of any application or transfer any application from one device to another. You shall not decompile, reverse engineer, disassemble, include in other software, or translate any application, or use the Services for any commercial purposes. You shall not modify, alter, change or otherwise make any modification to any application or create derivative works based upon any application. You shall not rent, lease, resell, sub-license, assign, distribute or otherwise transfer any application or these Terms. Any attempt to do so shall be void and of no effect.

3. Copyright

You acknowledge that no title to the intellectual property in the Services is transferred to you. You further acknowledge that title and full ownership rights to the Services will remain the exclusive property of the Developer, and you will not acquire any rights to the Services. You shall not remove or obscure the Developer's copyright, trademark or other proprietary notices from any of the materials contained in or downloaded together with the Services.

4. Disclaimer of Warranty

The Services are provided "AS IS", without warranty of any kind. The Developer disclaims and makes no express or implied warranties and specifically disclaims the warranties of merchantability, fitness for a particular purpose and non-infringement of third-party rights. The entire risk as to the quality and performance of the Services is with you. The Developer does not warrant that the functions contained in the Services will meet your requirements or that the operation of the Services will be error-free.

5. Limitation of Liability

In no event will the Developer be liable for special, incidental or consequential damages resulting from possession, access, use or malfunction of the Services, including but not limited to damages to property, loss of goodwill, computer or mobile device malfunction and, to the extent permitted by law, damages for personal injuries, property damage, lost profits or punitive damages from any causes of action arising out of or related to these Terms or the Services, whether arising in tort (including negligence), contract, strict liability or otherwise and whether or not the Developer has been advised of the possibility of such damages.

Because some states/countries do not allow certain limitations of liability, this limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. This limitation of liability shall not be applied solely to the extent that any specific provision of this limitation of liability is prohibited by any federal, state, or municipal law, which cannot be pre-empted. These Terms give you specific legal rights, and you may have other rights that vary from jurisdiction to jurisdiction. In no event shall the Developer's liability for all damages (except as required by applicable law) exceed the actual price paid by you for use of the Services.

6. Privacy

Privacy policies for the website and each application are available on the kntd website.

7. Indemnity

You agree to indemnify, defend and hold the Developer harmless from and against any and all damages, losses, and expenses arising directly or indirectly from: (i) your acts and omissions to act in using the Services pursuant to these Terms; or (ii) your breach of these Terms.

8. Changes

The Developer reserves the right, at their sole discretion, to modify or replace these Terms at any time. Any changes will be posted on this page. You should check this page from time to time and take note of any changes.

9. Subscriptions

kntd users may access the applications in the following ways:

Free Version: A programme that gives limited access for an unlimited time.

Free Trial: A free-of-charge programme which gives unlimited access for a limited time.

Paid Subscription: A subscription fee-based programme which gives access to all content. You will only have access to the Subscription Programme while your subscription is active and subsisting. You can become a subscriber by purchasing a subscription within the application, where allowed by the app marketplace partner. Please note that if you purchase a subscription through the Apple App Store or Google Play Store, the sale is final and we will not provide a refund. Your purchase will be subject to Apple's or Google's applicable payment policy, which also may not provide for refunds.

You may be offered a free trial of a subscription for a limited period of time. You are free to cancel a free trial at any time via the subscription settings in your Apple ID or Google Play account. Please note: your free trial will automatically renew as a paid subscription unless you cancel at least 24 hours before the end of the free trial period.

Paid subscriptions are auto-renewing. You will be charged the stated subscription amount upon completion of your registration and submission of your payment information or, if applicable, at the end of your free trial period if you have not cancelled at least 24 hours in advance of the expiration of the trial period. You hereby agree to and authorise automatic (recurring) billing, and you agree to pay the charges made to your account in connection therewith. You will be billed at the then-current applicable subscription price plus any applicable taxes. Payments for renewal subscriptions are processed using the same billing cycle as your current subscription. Subscription fees may change at any time, to the fullest extent permitted under applicable law. Your subscription will continue indefinitely until cancelled by you.
